5. 尽量不开私家车，可骑自行车和步行。这样既省电又省钱，还能为我们的健康带来了很大的保障。

6. 一水多用，淘米水可用来浇花、洗菜、冲厕所等。

7. 洗衣服时，尽量用手洗，这样既省水又省电。

[摘 要]因特网的发明及飞速发展为现今世界带来了极大的便利，同时也带来了诸多此前所没有的新课题。在著作权法领域，对于如何将原有的规范有形著作物的著作权法适用于新的网络上传输的无体著作内容的问题，各国甚至世界知识产权组织都在积极寻求对策。本文拟对网络环境下著作权保护的几个重要问题进行探讨。 [关键词]网络环境 著作权 保护 信息网络传播权 推定许可制度 知识经济正在全面取代工业文明，信息时代已经悄然来临。网络，像一张无形的大网，把整个世界“一网网尽”，使时空、距离遁然无形。人们可以在任何时候、任何地方随心所欲地进行联系、沟通、交流，享受网络带来的各种愉悦。网络作为人类知识创新成果，在为人类带来便捷、迅速、丰富多彩的信息的同时，也对诸多传统领域带来了前所未有的挑战，知识产权领域的著作权法便是首当其冲。本文拟就网络环境下著作权的相关问题进行阐述，以期有利于对该问题的探讨。 一、网络作品 为了保证作品创作者的利益，激发创作者的创作积极性，从而推动人类文化事业的发展，世界各国都制定了著作权法，保护在文学、艺术、科学领域内有独创性并且具有可固定性的作品，赋予创作者对其作品一定期限的专有权。那么在网络这个虚拟世界中，处于流动状态的信息是否也应受到著作权法的保护呢？ （一）网络作品的概念与分类 在网络这个浩瀚的信息海洋里，包罗了生活、教育、经济、科技、政治、军事、宗教等各个领域的信息。网络信息的存在与传播并不借助于传统的载体，而是以数字 0、1的形式存在并在计算机之间流动。其中那些没有经过智力加工的信息，由于缺乏“独创性”这一作品的实质性要件而不能称之为作品。而那些经过智力加工、符合作品实质性要件的网络信息则被我们称为网络作品。 网络作品可分为两种：一种称为数字化作品，是指进入网络前存在于纸、磁带等传统载体上， 只是通过扫描等方式转化为计算机能识别的数字编码，然后经过计算机组织、加工、存储，并在需要时把这些数字化了的信息重新以文字、图像、声音等形式表现出来的网络作品。另一种称为数字式作品，是从其被创作之时起就直接以数字形式存在于计算机上并在网络上传播的网络作品。计算机大大扩展了人类的能力，网络又以其超容量信息使创作活动更为简单，因此第二种形式的作品将会越来越多。 （二）网络作品应受到著作权法保护 我国著作权法要求一件智力创作成果要成为著作权法上的作品，必须具备独创性和可复制性。对于数字化作品，从传统作品到计算机存储器只不过是一种数字化的转化过程，同以往的摄影、录音等技术手段处理作品没有实质区别。同时，也不会因存在、传输方式的改变而丧失其原有的独创性和可复制性，因此它仍是作品，无论是该作品的原有形式还是数字化形式都应受到著作权法的保护。对于数字式作品，虽然其以数字形式在互联网上“流动”，可复制性与传统作品有所区别，但数字形式并不影响其可被感知，流动性也不能否定其可被复制性，它与著作权法立法宗旨和意图并不违背，也应当受到著作权法的保护。 对此问题，我国立法、司法实践已经做出了肯定。2000年12月最高人民法院制定并实施了《最高人民法院关于审理涉及计算机网络著作权纠纷案件适用法律若干问题的解释》（以下简称《解释》）。该解释第2条规定：“受著作权法保护的作品，包括著作权法第3条规定的各类作品的数字化形式。在网络环境下无法归于著作权法第3条列举的作品范围，但在文学、艺术和科学领域内具有独创性并能以某种有形形式复制的其他智力创作成果，人民法院应当予以保护。”由此，对网络作品的性质、是否能得到著作权法保护的争议已经告一段落。 二、信息网络传播权 （一）各国对网 络传输的立法保护 随着互联网技术的迅速发展，全球信息高速公路的形成，有关网络传输作品的纠纷日益增多。作品的网上传输成为一个急需解决的法律问题。但何种权利更适宜用来控制网络传输，各国有不同的解决途径。美国主张用发行权来保护著作权人的传输权，认为通过网络传输形式向公众发行作品和以其他传统形式向公众发行作品是一样的；欧盟则主张用传播权来保护著作权人的传输权，认为应把网络传输定位为“公众传播的权利”。 我国修改以后的著作权法明确规定了著作权人的信息网络传播权。我国对信息网络传播权的定义和原则精神主要来自于世界知识产权组织1996年12月20日通过的《世界知识产权版权公约》（简称WCT）。该公约第8条规定，在不损害伯尔尼公约有关条款规定的情况下，“文学和艺术作品的作者应享有专有权，可授权将其作品以有线或无线方式向公众传播，包括将其作品向公众提供，使公众中的成员在其个人选定的地点和时间获得这些作品”。 （二）我国信息网络传播权的内容、特征 在我国，信息网络传播权作为一项新的权利，具体是指作者或经授权的人有将作品通过网络向公众提供，使公众可以自选时间、地点和范围接触作品的权利。信息网络传播权的内容包括许可权、禁止权和获得报酬权。如果他人侵犯了著作权人的信息网络传播权，应按照著作权法，承担停止侵害、消除影响、公开赔礼道歉、赔偿损失等民事责任。信息网络传播权具有如下特征：（1）信息网络传播权的主体是作品的作者，作者有权把作品传输上网，也可以授权他人将其作品传输上网，他人未经许可不得擅自将作品传输上网；信息网络传播权的客体应是著作权法所保护的作品，既包括传统形式的作品（数字化后可在网上传输），也包括直接创作于计算机上的数字式作品（可直接在网上传输）；（3）信息网络传播权保护的是通过网络这一特定的媒体向公众提供作品的权利，它有别于发行权和传统的传播权，一个人取得了发行权或传统的传播权并不当然的取得网络传播权，反之亦然；（4）信息网络传播的对象必须是公众，即为不特定的和特定的多数人，如果是私人则不涉及到网络传播权。三、网络作品著作权的行使与限制 （一） 关于网络作品著作权的利益平衡思考 著作权保护制度是随着知识创新、知识扩散活动的历史进程而产生、发展、健全起来的，它的目的是通过对著作权人专有权利的保护，最终推动全社会的科技进步、文化繁荣和经济发展。著作权人与社会公众之间的利益平衡问题始终是著作权法的核心问题。 网络技术的出现给著作权法旧的利益平衡带来了世纪性的挑战。有人说技术进步带来的著作权制度变化的历史就是一部著作权扩张的历史，也有人说著作权的专有性已经被网络技术淡化，最终将会导致著作权的消亡。笔者认为，著作权法保护的范围扩大、水平提高等都是针对网络技术使著作权“专有性”、“地域性”弱化做出的反应。网络环境下著作权保护的“强化”与“淡化”其实是相辅相成的，只是面对新的挑战，著作权法为找到新的利益 平衡所做出的调整。 （二）网络作品著作权的推定许可制度 进入知识超速扩散、加速创新的网络时代，著作权人的可期利益和实际权益随着知识扩散超速度和信息传播高密度而显著增加，同样的智力成果在网络环境下很可能收益倍增或十倍增、百倍增。而且，网络传播技术的发展也使作品创作变得越来越容易，创作成本相对降低。所以笔者认为，作为一种对价，应当对网络著作权人权利的专有性加以限制，不应造成“遍地都是知识产权地雷阵，到处都有知识产权高压线，一迈步就触雷，一举手准触电”的社会效果，使社会公众举步维艰，动则得咎，最终压抑知识创新、阻碍知识扩散，与知识产权保护之初衷南辕北辙。 虽然著作权法中有关合理使用的规定，原则上对网络作品是同样适用的。但随着网络技术的特性和水平的不断提高，使用作品的方式会越来越多。实践中，判断一种行为是否属于“合理使用”，光靠几个原则性的规定往往很难认定。而要把所有的“合理使用”的具体情形都在法律中列举出来也不现实。所以，笔者不同意随意扩大网络环境下的不经授权、无需支付费用的“合理使用”的范围，而赞成建立“推定许可”制度，即只要作者同意将自己的作品上传，就可以推定其对网络充分开放的特性以及网络中的某些使用行为是明知而且是同意的。这样，他人无需取得权利人许可就可以转载和下载等，但要注意：应当支付适当的费用。使用费费率可由相关法律、行政法规做出规定，具体收费可通过网络著作权集体管理组织来实现。当然，著作权人也可以通过附随作品的声明或者技术手段等明示行为排除适用“推定许可”，禁止他人转载、下载等。 网络作品著作权的推定许可制度，辅之以健全的网络著作权集体管理组织，既能保障著作权人的经济权益，又能打破网络条件下的权利滥用和过度垄断；既充分尊重了权利人的意志，又易于操作，有利于减少纠纷的发生。 [ 吴汉东，胡开忠。无形财产权制度研究[M].北京：法律出版社，2001. 蒋志培。网络与电子商务法[M].北京：法律出版社，2001. 张 楚，孙 晔。美国电子商务法[M].北京：邮电大学出版社，2001. 窦雅萍
