摘要：循环经济是21世纪经济发展最先进的模式，它从根本上缓解和消除了环境与发展之间的矛盾，缓解人类社会的资源矛盾，实现经济活动的生态化转向。世界上先进国家早在上世纪就开始对循环经济进行立法，并通过长期的实践，制订了一整套较为完善的循环经济法律体系。我国与发达国家相比，循环经济发展较为落后，目前还处在源头防污的清洁生产阶段，在法律体系上，只颁布施行了《清洁生产促进法》，而且该部法律条文内容较为原则，无实施细则。我国建筑业在循环经济方向还处于从末端治理向源头防治的过渡阶段，我国建筑业的现状按清洁生产的要求还存在较多不完善，对人类健康和环境污染的现象也尚未完全得到有效控制，故在我国建筑业大力促进清洁生产是十分紧迫且十分重要的。结合发达国家循环经济的立法和模式的成功经验，对我国建筑业促进清洁生产，发展循环经济提出了制订《建筑业清洁生产促进法》，制订和调整建筑业有关规范和标准，根据清洁生产要求修改《建筑法》，制订相关的规章制度等法律建议，使我国建筑业真正做到清洁生产，快速实现循环经济。

Abstract:Circulationeconomyisthemostadvancedeconomicdevelopmentmodelinthe21#century.Italleviatesandeliminatesthecontradictoryrelationshipbetweenenvironmentanddevelopment,alleviatingthescarcenessofresourcesinhumansociety,andachievingecologicaltransitionofeconomicactivities.Developedcountriesbegantolegislateforcirculationeconomyfromlastcentury,andhaveestablishedaperfectlegalsystemforitthroughlong-paredwiththecirculationeconomyindevelopedcountries,thecurrentsituationinChinaislessadvanced,andisstillatthestageofcleanproduction,whichonlyfunctionsasinitialprevention.Fromtheperspectiveoflegalsystem,ChinesegovernmentjustenactedtheLawofAdvancingCleanProduction,whichonlycontainsprincipledarticlesinsteadofdetailedaccountsforexecution.Fromtheviewpointofcirculationeconomy,constructionindustryinChinahasnotsurpassedthelevel,onwhichthefinalregulationoradministrationistransitingtowardstheinitialprevention.InaccordancewiththeLaw,thecurrentsituationofconstructionindustryinChinahasnotfulfilledthelegalrequirementsfully,andthephenomenaofhumanhealthandenvironmentalpollutionhavenotbeenundercontrolcompletelyyet,biningthesuccessfulexperiencesoflegislationandmodelsofcirculationeconomyindevelopedcountriesandthecurrentsituationsinChina,thisresearchproposestoestablishtheLawofAdvancingCleanProductioninConstructionIndustry,tosetupandadjuststandardsinconstructionindustry,toamendtheLawofConstruction,andtoestablishrelevantregulationsandpolicies,inordertoachievecleanproductioninconstructionindustryandacceleratetherealizationofcirculationeconomyinChina.
